~ Letter of Engagement

This letter is to set forth our understanding about what legal services I will provide to you and the cost of those services. 

1.      Services

My goal is to provide you with quality legal services relating to the [fill in particulars] [sale of your home].  Although I am licensed as a real estate broker, I am not acting as your broker in this transaction and you have indicated there will likely not be a broker involved.  [Because there is no broker involved, I have provided you with forms and pricing information, but we agree this does not constitute an agency relationship and that you will hold me harmless against any losses that I may incur as a result of others thinking that is the case.] I can, as your attorney, direct you and your buyers to appraisers, inspectors, title companies, mortgage companies and others typically involved in home sale transactions, but I am not responsible for these individuals or the results they obtain for you.  I will not seek or receive any remuneration for theses types of referrals.

 Fixed Fees

 

You are selling your home yourself and have selected the services at the fixed fees described on the attached schedule.  Any time spent beyond that for those services will be billed at hourly rates as described below.  I will advise you if and when the services will be outside the fixed fee before incurring those charges. 

Hourly Fees

My hourly rate is $250 effective February 1, 2010.  This will include all typical costs such as telephone charges, faxes and photocopying.  It will not include any filing fees or charges imposed by third parties.  I will report to you as often as you desire the amount of the charges you have incurred, but the accumulated bill may be paid at closing out of the proceeds of the sale, or, if no closing occurs, within 30 days of the date that is apparent.  Any final charges for services after the closing will be sent no later than a month after they are incurred. Interest will accrue on amounts unpaid for 45 days at a rate of 10% per annum. 

Termination

You have the right to terminate my representation at any time by letting me know. I will send your file to whomever you direct.  I have the same right, but must give you enough notice to make arrangements for alternative representation.
